Is romance required for domestic violence?

Excellence is our standard.

There's no requirement for romance. The statute only requires that the two individuals either live together or formerly have lived together. Same sex couples fall under the statute. Furthermore, hitting one's child or a child living in the same home potentially constitutes as a domestic assault. That said, however, I would have a lot of fun in court if two fraternity brothers were charged with domestic assault instead of assault and battery after getting into a fight over football.

For many individuals, a domestic violence conviction is simply not an option. A conviction for domestic violence has significant and permanent collateral consequences.
